By accessing or using cabo.la (the "Site"), operated by @Cabo ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Site. We reserve the right to update these terms at any time, and your continued use of the Site constitutes acceptance of any changes.
2. Services
@Cabo is a luxury travel concierge platform that connects travelers with vacation rental properties, yacht charters, curated experiences, restaurant recommendations, and event planning services in Cabo San Lucas and the greater Los Cabos region of Baja California Sur, Mexico. We act as an intermediary between guests and property owners, operators, and service providers.
3. Booking & Reservations
All bookings made through the Site are subject to availability and confirmation by the property owner or service provider. A booking is not confirmed until you receive written confirmation from our team. Prices listed on the Site are estimates and may vary based on dates, group size, and availability.
- A deposit may be required to secure your reservation.
- Full payment is typically due 30 days prior to your arrival date unless otherwise specified.
- All payments are processed securely through our payment partner, Stripe.
4. Cancellation & Refund Policy
Cancellation policies vary by property and service provider. General guidelines:
- 60+ days before arrival: Full refund minus processing fees.
- 30–59 days before arrival: 50% refund of the total amount.
- Less than 30 days: No refund, unless otherwise agreed upon.
- Yacht charters & experiences: Subject to individual operator policies, provided at time of booking.
We strongly recommend purchasing travel insurance. @Cabo is not responsible for losses due to cancellations, weather, travel disruptions, or force majeure events.
5. User Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws.
- Submit false, misleading, or fraudulent information.
- Interfere with the proper functioning of the Site.
- Attempt to gain unauthorized access to any portion of the Site.
- Scrape, copy, or reproduce content from the Site without written permission.
6. Intellectual Property
All content on the Site — including text, images, graphics, logos, and software — is the property of @Cabo or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our express written consent.
7. Third-Party Services
The Site may contain links to third-party websites and services (restaurants, activity operators, property management companies). We are not responsible for the content, policies, or practices of any third-party site. Your use of third-party services is at your own risk.
8. Limitation of Liability
@Cabo acts as a concierge and booking facilitator. We are not the owner or operator of the villas, yachts, or experiences listed on the Site. To the maximum extent permitted by law:
- We are not liable for personal injury, property damage, or loss arising from your use of any booked service.
- We are not responsible for the condition, accuracy of descriptions, or availability of third-party properties and services.
- Our total liability for any claim shall not exceed the fees paid by you to @Cabo for the specific service in question.
9. Indemnification
You agree to indemnify and hold harmless @Cabo, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of Mexico. Any disputes arising from these Terms shall be resolved in the courts of Baja California Sur, Mexico.
